Continuances

If you case was continued, click here to find your new court date. Some counties take a few days before they update the case file, so please check back after a few days.

North Carolina Rules of Professional Conduct have determined that it is the Attorney's choice, using his professional judgment, as whether to continue a case or not.  This is not a choice that the Defendant has the authority to override the Attorney.

If your case has been continued, the first thing to ensure is that you have submitted all the required documents to the Attorney.  It should be noted that according to the Attorney/Client Agreemet, if the Law Firm has to appear in court a third time, or beyound, due to a lack of required documents, advance court costs, payment of attorney fees, or anything else that is relevant to the case that is required by the Law Firm, then each court appearance after the second court appearance, will result in the Defendant being charged a twenty-five dollar fine.

Below is a list of required documents that are commonly forgotten.

-Attorney/Client Agreement with Waiver of Appearance.

-Non-Certified Driving Record. (if you were told that the Attorney believed he would try to reduce the charge to an Improper Equipment or a Prayer For Judgment Continued in either Mecklenburg or Rowan Counties, then the driving record is REQUIRED, or if the Attorney told you that it would be required.  This may be obtained from the DMV website and emailed to the Law Firm.
*This requirment is also stated in the Attorney / Client Agreement. 

-If your case involved an accident, then a letter from your insurance stating all claims have been paid.

-A money order for the court costs in Gaston County. This must me made payable to the "Clerk of Court" and mailed to the Law Firm's Office.

-You have not paid your attorney fee in full.

Sometimes, the Attorney will decide that it is not in the best interest of the Defendant to resolve the case on a particular day.  This may be due to a harsh Judge or Assistant District Attorney presiding that day.
